Officials Rule BGS Win Goes to Brown, not Myers

(Bowman Gray Stadium, Winston-Salem, NC) Burt Myers led the pack when the checkered waved tonight at Bowman Gray Stadium. It was Burt Myers who received the trophy and had his pictures taken in Winner’s Circle.

But it was Tim Brown who won the race.

The controversy started on lap 49 of the USG Modified 50. The Farm Bureau Insurance Modified Series had competed in an uncharacteristically calm race, with no caution being thrown for the first 48 laps. Although pole starter Tim Brown of Cana, Va. and outside pole starter Burt Myers of Walnut Cove fought side-by-side for the lead in the first two laps, Myers eventually settled back into second to wait for a better time to strike.

Myers delivered a few good taps to the rear of Brown but was unable to shake Brown out of the lead. Brown then began to push hard, increasing the distance between his #83 car and the #1 car of Myers.

But as the field came around to receive the white flag, Lee Jeffreys spun out on the front stretch. Tim Brown slowed, thinking that a caution was inevitable. The caution lights around the track came on, but the flagman never threw the caution flag. Although Brown slowed, the action never halted – Myers was able to get by Brown to claim the lead as the white flag was waving.

Burt Myers finished out the final lap in the lead, taking the checkered and receiving his trophy in front of the fans.

NASCAR Officials reviewed the race and determined that the victory actually belonged to Tim Brown. According to Bowman Gray’s race procedure rule book, a display of the caution lights and/or the caution flag waving will bring about a halt of the race. At that point, the field freezes and the racers restart where they were when the caution came out. “The caution lights were on, therefore the field was frozen according to our race procedures,” said NASCAR Race Director John Horton.

“I just checked up cause there was smoke,” said Tim Brown about the incident when Lee Jeffreys spun. “Then I saw it was a caution, so I thought everything was cool. Then the cars go flying by and my spotter tells me they didn’t throw the caution.”

“The stadium went back and went by the rules,” said Brown. “I hate it for Burt, but I also hate it for myself, because I had a dominant car and I didn’t get to celebrate it with the fans.”

Myers sees things differently. “If they never throw the caution flag and we run the last laps under green, how can it not be my win? It’s cut and dry. It’s plain and simple,” said Myers.

A formal protest of the finish has been lodged by Burt Myers, and the finish from the USG Modified 50 will now be reviewed by NASCAR.

Jeremy Stoltz of Walkertown finished third, Brian Pack of Walkertown finished fourth, and Bobby Hutchens of Lexington finished in fifth.

In the first 20-lap race for the Webb Heating & A/C Co. Sportsman Series, Rookie Derek Stoltz took his second win of the season on Saturday. Scott Hall finished in second, and Mitch Gales took third. In the second 20-lapper, Barry Edwards of Pinnacle claimed victory, with David Adams of Yadkinville finishing second and Kyle Edwards of Pinnacle, Barry’s brother, finishing in third.

Tim Vaden of Kernersville was the winner of the 50-lap race for the 104.1 WTQR Street Stock Series – the division’s longest and most prestigious race of the season. Ryan Nelson of Winston-Salem finished second, with Ethan Stoltz of Walkertown taking third.

In the Time Warner Cable Stadium Stock Series, Andrew Sanders of Mocksville took checkered in the first 15-lapper, with Glenn Hamilton of Winston-Salem winning the second 15-lap race.
